These terms govern access to EQS-AI software, demonstrations, training, support, and related services provided by Engineered Quality Solutions LLC.
By creating an account, submitting a request, or using EQS-AI, the user confirms that they can accept these terms for themselves or their organization. A signed order form, pilot agreement, statement of work, or enterprise agreement controls if it conflicts with these online terms.
Users must provide accurate information, protect credentials, and use only the company, project, SPC, OEE, training, and administrative access assigned to them. Customers are responsible for user authorization, role assignment, lawful data collection, and prompt removal of access when no longer needed.
Users may not bypass access controls, probe or disrupt the service without written authorization, upload malicious code, infringe rights, misuse another customer’s data, resell access without agreement, or use EQS-AI for unlawful, unsafe, or deceptive purposes.
Customers retain ownership of information they submit. Customers grant EQS the limited right to host, process, back up, transmit, and display that information as necessary to provide and secure the service. Each party will protect confidential information using reasonable safeguards and use it only for the agreed business relationship.
AI features may generate incomplete or incorrect suggestions. Users must independently review calculations, statistical interpretations, reports, decisions, and regulated or safety-related outputs before use. Customers should not submit restricted information to AI features unless their agreement and internal policy authorize it.
Paid access, seat quantities, billing cadence, training scope, cancellation, renewal, and taxes are governed by the applicable checkout, quote, or order form. Except where required by law or expressly agreed, fees already earned are non-refundable.
Features labeled beta, pilot, preview, sample, or demonstration may change and may have additional limitations. Pilot customers should use sample or approved non-production data unless a written pilot and data-security agreement authorizes production use.
EQS and its licensors retain rights in the software, modules, methods, designs, documentation, and service improvements. These terms provide a limited, non-exclusive, non-transferable right to use the service during the authorized subscription or engagement.
EQS will provide the service with commercially reasonable care but does not promise uninterrupted or error-free operation. To the extent permitted by law, implied warranties are disclaimed and liability is limited by the applicable order form or agreement. EQS-AI does not replace professional engineering judgment, legal advice, regulatory review, or required safety controls.
EQS may suspend access needed to address security, nonpayment, unlawful use, or material breach. On termination, customer access ends subject to agreed export and retention terms. Material updates will be posted with a revised effective date.
